1. 2년의 본국 거주조건이 있는  J 비자를 받은 사람은
2. 식구를 포함하여
3. H 또는  L 체류신분으로 변경하던가, 영주권을 신청하거나 또는
4. 체류신분 변경을 위하여 (A 나 G 비자는 해당 안됨) 
5. 외국에서 2년 이상을 거주해야만 자격이 된다는 것을 
6. 국무성과 이민국으로부터 Waiver를 신청하여 받는 것

1. Public fund - 참여하는 프로그램이 직접이나 간접적으로 미국정부나 본국정부의 기금으로  이루어 졌거나 
2. DOS skill list - 국무성에서 발표하는 기술리스트에 있는 경우로 비자를 받거나
3. 1977년 1월 10일 이후에 의학대학원에 교육이나 훈련을 받는 경우이다 (sponsorship under ECFMG).

1. Exceptional hardship waiver - 시민권자의 자녀나 배우자에게 경제적,  신체적, 정신적, 또는 직장, 교육, 건강등의 문제로 큰 어려움 될 때나 인종, 종교, 또는 정치사상으로 박해의 가능성이 있을 때
2. No objection waiver - 의과 대학원생을 제외하고 본국에서 꼭 본국으로 돌아오지 않는 것에 반대하지 않을 때
3. National interest waiver - 미국의 연방정부나 주정부에서 필요추천이 있을 때
4. 의학 대학원생으로 정부로부터 의사가 미달되는 지역에 취업으로 추천을 받을 때
5. 의학 대학원생은 주로 환자를 보는 의사의 프로그램만 waiver에 해당이 되나 2002년 3월 부터 농산부에서 진행하던 waiver프로그램을 중단하였다.
6. 그러므로 환자를 보던 의사들은 ARC (Appalachian Regional Commission), HHS (Department of Health and Human Services), VA (Veterans Administration), 또는 Conrad State 20 Program 정도가 남아있디. 
7. 캘리포니아, 아이다호, 캔사스, 오클라호마, 오리곤, 텍사스, 와이오밍주는 Conrad 20 State Program을 사용하지 않는다. 

다른 체류 신분과는 달리 동반 배우자나 자녀는 Work Permit을 신청할 수 있다. 신청은 J-1의 수입원, 동반 식구의 Work Permit 신청이유, 식구의 수입원이 J-1의 생활 보조원으로 사용하지 않는 다는 설명등을 첨부하여야 한다.    

1. 본국이란 자신의 국적을 가진 나라 또는 마지막으로 거주한 국가이다.
2. 2년 기간은 본국에 실제적으로 거주한 기간을 뜻하며, 계속 될 필요는 없다.
3. 본국에서 B, E, F, M, O, R, TN등의 비자로 입국을 하는 것은 허용이 되나, 영사가 2년의 기간내에는 잘 안주는 경우가 있고, 다른 비자로 미국에 있는 기간은 2년에 포함되지 않는다.
